Terms of Service

1. Accounts

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be at least 16 years old and authorized to bind the organization you register on behalf of.

2. Acceptable use

You agree not to:

• use the Service to send unlawful, deceptive, or unsolicited bulk communications;
• upload data you do not have the right to process;
• attempt to breach, probe, or disrupt the Service or its infrastructure;
• reverse engineer, resell, or sublicense the Service without our written consent.

3. Your data

You retain all rights to the data you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide and support the Service. Our handling of personal data is described in our Privacy Policy and, where applicable, our Data Processing Addendum.

4. Third-party integrations

You may connect third-party services such as Google. Your use of those services is governed by their own terms, and you authorize FlyCRM to access data from them as described at the time of connection. You can disconnect an integration at any time in Settings → connected accounts. We are not responsible for third-party services or their availability.

5. AI features

FlyCRM includes AI-assisted drafting and summarization. Output may be inaccurate or incomplete, and you are responsible for reviewing anything before you send or rely on it. We do not use your Customer Data or connected-account data to train generalized AI models.

6. Fees and subscriptions

Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice before your next renewal.

7. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may add, modify, or remove features; we will not materially reduce core functionality of a paid plan during a paid term without notice.

8. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or where required by law. On termination we will delete Customer Data in line with the retention periods in our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.

11. Governing law

These Terms are governed by the laws of the State of California, excluding its conflict of laws rules, and the parties submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California.

12. Changes to these Terms

We may update these Terms. We will update the "Last updated" date and notify account holders of material changes before they take effect. Continued use after the effective date constitutes acceptance.
